Applicability of Rules.- (1) Where an application is made to the Court under the provisions of the Act in the voluntary winding-up of a company, whether or not an order shall have been made that the voluntary winding-up shall continue subject to the supervision of the Court, these Rules, so far as may be, shall be applied to the subject matter and mode of such application. (2) Save as aforesaid, rules which from their nature and subject matter, or by the headlines above the group in which they are contained or by their terms are made applicable only to proceedings in a winding-up by the Court or only to such proceedings and to proceedings in a creditors' voluntary winding-up, shall not apply to proceedings in a voluntary winding-up, or, as the case may be, in a members voluntary winding-up, whether any such voluntary winding-up is or is not being continued under the supervision of the Court. |
