260. Applications under section 542 or 543.- An application under subsection (1) of section 542 or under sub-section (1) of section 543, shall be made, by a summons returnable in the first instance in Chambers. The summons shall state the nature of the declaration or order for which the application is made, and the grounds of the application, and shall be served on every person against whom an order is sought not less than 8 days before the day named in the summons for the hearing of the application. It shall not be necessary to file any affidavit or report before the return of the summons. The summons shall be in Form No. 120 or 121 with such variations as may be necessary.
