Bihar Regional Development Authority (Amendment) Act, 2006

ACT
To amend the Bihar Regional Development Authority Act, 1981 (Bihar Act 40,1982)
Be it enacted by the Legislature of Bihar in the fifty seventh year of the
Republic of India as follows :–

1. Short Title, Extent and Commencement – (1) This may be called Bihar
Regional Development Authority (Amendment) Act, 2006.
(2) It shall extend to the whole of the State of Bihar.
(3) It shall come into force at once.

2. Amendment in sub-section (1) of Section 37 of the said Act shall be made as
follows –
After the word “thereunder” a semi-colon (;) shall be substituted for full stop
(.) and after that a new following provisio shall be added.

“provided that for residential building measuring plot area upto 500 sq.
meters, architects empanelled under the bye-laws framed under this Act shall
be authorised to sanction the erection of the building or addition or alteration
there to if such erection of the building or addition or alteration thereto would
not contravene any provison of this Act or any regulation made thereunder.”

3. Amendment in section 44 of Bihar Act, 40, 1982 –
The sub-section (2) of section 44 of the above said Act shall be hereby
deleted.

4. Repeal and Saving – Not withstanding such deletion of sub-section (2) of
Section 44 of the Act, the same shall not affect any right, privilege, obligation
or liability acquired or incurred and be deemed to have to be done or taken
in exercise of the provision of the Act.
