Assam Autonomous Districts Administration of Justice (Miscellaneous Provisions) Act, 1957
Preamble.- An Act to provide for the transfer of certain cases
from the Courts of the Deputy Commissioner and his Assistant
to the District Council Courts;
Whereas it is deemed necessary to make provisions for the
transfer of certain cases to the Counts constituted under
the paragraph 4 of the Sixth Schedule to the Constitution
of India in the Autonomous Districts of Assam:
It is hereby enacted in the Eight year of the Republic of
India as follows:
Act XXII of 1957
1. Short title, extent and commencement.-
(1) This Act may be called the Assam Autonomous Districts
Administration of Justice (Miscellaneous Provisions) Act,
1957.
(2) It shall extend to the Autonomous Districts of Assam.
(3) It shall come into force on such date as the State Government
may direct and it may be brought into force on such date as
the State Government may direct and it may be brought into
force in different areas on different dates.
2. Transfer of certain cases.-
The Deputy Commissioner and an Assistant to him shall have
no power to try a case which is exclusively triable by any
Court constituted under paragraph 4 of the Sixth Schedule
to the Constitution of India; and any case which at any stage
after the Deputy Commissioner or an Assistant to him has taken
cognizance of, transpires to be so triable, shall be transferred
to a competent Court as soon as it so transpires.
