109. Cognizance of offences.- (1) No Court inferior to that of a Presidency Magistrate or a Magistrate of the first class shall try any offence under this Act. (2) No Court shall take cognizance of any offence punishable under sub section (4) of Section 34B or sub section (1A) of Section 102 except upon complaint in writing made by an officer of the Central Government generally or specially authorised in writing, in this behalf by the Authority, and no Court inferior to that of a Presidency Magistrate or a Magistrate of the first class shall try any such offence. | |||||
