3. Presentation of application.- Notwithstanding anything contained in these rules, the application shall be presented to the court by the applicant in person, unless he is exempted from appearing in court, in which case the application may be presented by an authorised agent who can answer all material questions relating to the application, and who may be examined in the same manner as the party represented by him might have been examined had such party attended in person:

Provided that, where there are more plaintiffs than one, it shall be sufficient if the application is presented by one of the plaintiffs.


HIGH COURT AMENDMENTS

Allahabad.- After the words “unless he is exempted from appearing in Court” add the words “or detained in prison”. (8-5-1937).

Andhra Pradesh.- Same as that of Madras.

Kerala : Laccadive, Minicoy and Amindivi Islands.- To Rule 3, the following Explanation shall be added, namely:

“Explanation. - Where there are more applicants than one presentation by one shall be deemed to be sufficient compliance with the provisions of the rule.” (9-6-1959).

Madras: Pondicherry, Karnataka.- The following shall be added to Rule 9:

“The High Court may be general or special order exempt any person or class of persons from the obligation to present in person an application for permission to sue as a pauper.”
