158. Conditions prescribed under section 4 (xxiii) (b). -For the purposes of the Act and these rules, the expression “officer”, in relation to a person subject to the Act, includes a person gazetted, commissioned or in pay as an officer of the regular Army or the Navy, as the case may be, when the person subject to the Act is serving under any of the following conditions, namely: - (a) When he has been placed under the orders of such officer; (b) When he is being conveyed in or is on board a vehicle, vessel or aircraft which is being commanded by such officer; (c) When he is serving in or is a patient in a hospital or medical establishment in which such officer is on duty; (d) When he forms part of or is serving with a body of the Air Force which is acting with a body of the regular Army or the Navy, and any one of these bodies is on active service. (e) When he forms part of or is serving with a body of the Air Force acting in an emergency with a body of the regular Army or the Navy and an order in writing is made by the officer commanding that body of the Air Force that an emergency exists and it is necessary for the officers of the regular Army or the Navy, as the case may be, to exercise command over persons subject to the Act; NOTE: -A copy of every such order shall for with be sent to the Central Government; (f) When he is serving in any place in which or with any body of the Air Force with which, there is present any officer of the regular Army or the Navy and the Central Government has by special order declared that it is necessary for the officers of the regular Army or the Nevy to exercise command over persons subject to the Act in that place or with that body of the Air Force.
